New2 Media provides a cloud-based software platform (known as Rare Social) that helps businesses to grow their social media audience. The Service is accessible via web browser and/or mobile applications and is provided on a subscription basis.
Account Registration and Security

To use the Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.
Account Responsibility
You are solely responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Company Ownership

In no event shall the Company’s total cumulative liability for all claims, damages, losses, and causes of action arising out of or related to these Terms or the use of the Service exceed the greater of (a) the total amount paid by you to the Company for the Service during the twelve (12) months immediately preceding the event giving rise to such claim, or (b) one hundred U.S. dollars ($100), whichever is lower.
You acknowledge and agree that the limitations set forth in this section reflect a reasonable and fair allocation of risk between the parties and that these limitations form an essential basis of the bargain between you and the Company. The Service is provided at a price that reflects this allocation of risk and these limitations of liability.
Certain jurisdictions do not allow the exclusion or limitation of liability for certain types of damages; in such jurisdictions, the Company’s liability shall be limited to the maximum extent permitted by law.
This limitation of liability applies regardless of the form of action or theory of liability, and it shall survive the termination, expiration, or cancellation of your account or these Terms.
Termination
The Company may terminate or suspend your Account and access to the Service at any time, with or without cause or notice. Upon termination, all licenses granted under these Terms will immediately cease.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the UK, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the UK.
Changes to Terms
The Company reserves the right to modify these Terms at any time. Updated versions will be posted on the Service and will be effective upon posting. Continued use of the Service constitutes acceptance of the revised Terms.
